1. Acceptance of Terms

By downloading, installing, or using Diwadi ("the Application"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Application.

Diwadi is developed and maintained by Vysakh Sreenivasan ("the Developer") as an independent desktop application project.

2. Description of Service

Diwadi is a desktop application that provides productivity tools with optional AI-powered assistance. The Application:

• Processes most features locally on your device (document conversion, image/video compression, data tools)
• Offers AI-powered features through your choice of AI providers (OpenAI, Google Gemini, or others)
• Transmits your prompts and any files you ask AI to analyze to your chosen AI provider
• Does not permanently store your data on our servers
• Requires an internet connection only for AI features - other features work offline
• Is provided with a generous free tier

3. User Responsibilities

You are responsible for:

• All activities that occur through your use of the Application
• Ensuring your use of the Application complies with all applicable laws and regulations
• The content you submit to the Application (prompts, files, data)
• Not submitting sensitive, confidential, or illegal content in AI prompts or files sent for AI analysis
• Understanding that AI prompts and files are processed by your chosen third-party AI provider and subject to their policies
• Maintaining the security of your device and internet connection

4. Third-Party Services

The Application offers AI-powered features through multiple AI providers (OpenAI, Google Gemini, and others). Your use of AI features means your prompts and files are processed by your chosen provider according to their terms of service and privacy policies. The Developer is not responsible for:

• The availability, accuracy, or quality of AI provider services
• Any changes to AI provider service terms, pricing, or availability
• Data handling practices of AI providers
• The responses or outputs generated by AI models
• Any service interruptions or limitations imposed by AI providers

You agree to review and comply with OpenAI's Terms of Use and Usage Policies.

5. Telemetry and Analytics

The Application collects limited telemetry data consisting of:

• Anonymous usage events (e.g., feature interactions, error occurrences)
• Application performance metrics
• Technical information (operating system, application version)

This data is used solely to improve the Application. No personal information, conversation content, or CLI credentials are collected.

6. No Warranties

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE DEVELOPER MAKES NO WARRANTIES REGARDING:

• The accuracy, reliability, or availability of the Application
• The Application's compatibility with your system
• The results obtained from using the Application
• The Application being free from errors or interruptions

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Application
• Any unauthorized access to or use of your data
• Any interruption or cessation of the Application
• Any third-party services accessed through the Application

8. Intellectual Property

The Application, including its original content, features, and functionality, is owned by Vysakh Sreenivasan and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Modifications to Terms

The Developer reserves the right to modify these terms at any time. Changes will be effective immediately upon posting the updated terms. Your continued use of the Application after any such changes constitutes your acceptance of the new terms.

10. Termination

You may stop using the Application at any time by uninstalling it from your device. The Developer may discontinue the Application at any time without notice.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions.
